UAE Law of Personal Affairs has been issued in 2005 by Law No. 28 of 2005 and it stipulates in the provisions and articles thereof the cases of competence for the court of personal affairs in the state as well as the procedures of litigation before such courts and the ways of contestation by way of appeal and cassation as well as the dates of contestation.
The date of contestation by cassation is different from the appeal judgments issued in the personal affairs from the date scheduled for the contestation by cassation in the public law (civil procedures law), as the contestation by cassation in the personal affairs is thirty years according to article (15/3) of personal affairs law, while the date of contestation by cassation in the public law (civil procedures law) shall be sixty days.
The personal affairs law has regulated the provisions of the engagement and public provisions of the marriage, the consequences thereof and the provisions of the divorce and separation. Moreover, the law organized the provisions of the custody, lineage, capacity and will including the provisions of mandatory will and inheritance. It should be noted that before issuance of these provisions and the personal affairs law, the reference in this regard was the provisions mentioned in the Maliki Doctrine that has the priority in the implementation before the courts.
